The minutes regarding contraventions in electronic communications, postal communications and information technologies, drawn up by ANRCETI (www.anrceti.md), are entered in the Register, this being followed by a decision to either apply a contravention sanction or to file the case to competent court or another contravention-determining party for resolution. This clause stipulated in the new Contravention Code, is reflected in Decision no.145 of 23.06.2009 of ANRCETI Administrative Board, to approving the provisional procedure on stating a contravention in the aforementioned fields.

Owners of short range radiocommunication devices have the right to use several categories of frequencies without priorly obtaining a license for the use of radio frequencies/channels or a technical permit. This right is provided for in ANRCETI (www.anrceti.md) Administrative Board Decision on establishing the categories of radio frequencies, for the use of which no general authorization requirements are applied and no license or technical permit is required. The decision became effective on Friday, June 19, as it was published in the Official Gazette.

Sergiu Sitnic, Director of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI), when asked to comment on the results of the EBRD assessment on the development of communications in transition economies with respect to Moldova, said that by the end of this year a new tool intended to safeguard competition will be applied on the electronic communications market – a mechanism required by the legislation in force and the recommendations recently provided by the European Bank for Reconstruction and Development (EBRD). The aforementioned assessment was presented at the end of May in Tbilisi, Georgia, an event attended by an ANRCETI delegation.

The providers of public fixed and mobile telephone networks are now under the obligation to ensure the access to Freephone numbers free of charge for callers. These numbers are assigned by the national Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) from the National Numbering Plan, based on licenses. This is a provision of ANRCETI Administrative Board Decision on regulating the provision of Freephone in public electronic communications networks, in force on Friday, June 5, 2009, after being published in the Official Gazette.
