In 2011, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) organized 35 public hearings, debates and sessions, of the Administrative Board dedicated to draft decisions with major impact on electronic communications markets, which were subject to public consultations during the year. These are data contained in the ANRCETI Report (doc. in state language) on Transparency in Decision-Making Process in 2011, published today on the regulator’s Internet page.
The Report specifies that the public debates took place within the sessions of the working groups and of the Administrative Board and were attended by representatives of providers, other public authorities and mass media. The most active participants were the representatives of companies JSC „Moldcell”, JSC „Orange Moldova”, JSC „Moldtelecom”, „Arax Impex” LLC and National agency for Competition Protection.
In the reporting year, the regulator proposed for public consultations 29 draft decisions, of which 23 were approved in Administrative Board public sessions, and 6 – are due in the first quarter of 2012. During the public consultations, the agency received 240 recommendations proposed by the stakeholders with regards to the draft documents. 111 of these – were found reasonable and produced further modifications and amendments to the draft documents under consideration. The reasons for which the Agency did not accept 129 recommendations are explained in the synthesis of recommendations, these being subsequently published on the Agency Web page.
Most of the publicly consulted and approved decisions provide for a number of actions with regards to identification, analysis and regulation of electronic communications markets in order to ensure their functionality in competition environment, with efficient use of numbering resources, implementation of number portability, protection of end users’ rights by setting minimum service quality parameters and placing the obligation on providers to measure and make the indicators publicly available.
The Report was developed by the Agency pursuant to the Law no.239-XVI of 13.11.2008 on Transparency in Decision-making Process, Government Decree no.96 of 16.02.2010 and Rules for development and approval of acts of normative, individual, recommendable character and for ensuring transparency in decision-making process, approved by Administrative Board Decision (doc. in state language) no.12 of 09.04.2010.
