Public Consultations on Draft Decision Regulating Access to Numbers Independent of Location

The National regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) has placed on its Web page, for public consulations, draft Administrative Board Decision on regulating the access to numbers independent of location. Recommendations on the consulted document are welcome till August 6, 2010

The draft was developed by the Agency under Article8 (5) a) and b) and Article 21 (A) of the Law on Electronic Communications No. 241-XVI of 15. 11. 2007 and aims at ensuring appropriate conditions for the use of numbers independent of location and stimulate the development of this type of services on the domestic electronic communications market.

Prior to the development of the draft, the Agency prepared the preliminary regulatory impact analysis (RIA) which has undergone public consultation process by means of the Web page during the period April 26 – May 10, 2010. Subsequently the RIA was examined and supported by the working group for regulating business activity. With reference to this document the Agency received comments and proposals from companies „Orange Moldova”, „Moldtelecom” and „Moldcell”. They are included in the synthesis of recommendations, published on the Agency’s Web page .

The authors of the draft document reason the action of regulating the access to numbers independent of location by the need to remove the existing structural and competitive barriers on this market to prevent actions aimed or having as effect the distortion or restriction of competition. According to the Informative Note accompanying the draft document, the Agency intends to issue clear regulations on the pricing of wholesale and retail telephone calls to numbers independent of location. The Agency believes that the enforcement of these rules will have a positive impact on the end users, by giving them the possibility to use new generation services at advantageous prices.

Last year, the Agency exposed for public consultation a draft decision - approving special license conditions for the use of numbers independent of location. The Board intends to approve in the same public hearing both draft decisions on access to numbers independent of location.

For services provided via numbers independent of location, the Agency will assign to applicants numbers from „30xxxxxx” and „38xxxxxx” number blocks, as provided by the National Numbering Plan
