In the timeframe April - June 2015, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) performed planned 24 inspections of the activity of electronic communications network/service providers, in which they verified the compliance with normative acts relevant for electronic communications. The inspections were carried out in accordance with the Schedule, developed according to the Law on State Control over Entrepreneurial Activity, approved by the ANRCETI Director and published on ANRCETI official website.
All providers subject to inspections are included in the Public Register of electronic communications networks/services providers, based on general authorization regime. As a result of the inspections, ANRCETI representatives draw up 22 inspection records and 2 reports ascertaining the absence of the inspected business at the address provided in the Public Register of providers.
Inspection findings showed that 12 providers worked without admitting of deviations from legal norms, 10 providers admitted of breaches and two providers did not perform any electronic communications activity. The latter, upon ANRCETI’s proposal, applied for waiver of the right to provide publicly available electronic communications networks and/or services, granted by ANRCETI under the general authorization regime.
According to inspection documents the most common violations identified by ANRCETI representatives were: non-payment of the regulatory and monitoring fee (25%), nonconformance of contracts for electronic communications service provision with the legal acts in force (21%), failure to submit reports on income from electronic communications activities in due deadlines (21%), failure to publish the information on quality of services parameters and submit it to ANRCETI (17%), failure to inform ANRCETI about changes in the information initially indicated in the original notifications (8%) , failure to present statistical reports within the deadlines (4%), lack of Planned Inspections Register (4%).
It’s notable that most violations found during inspections were duly removed within the timeframes set by ANRCETI.
According to the Schedule of Inspections for Qtr. III of 2015, in this timeframe ANRCETI will perform 15 planned inspections. They will focus mainly on checking the providers’ compliance with the provisions of the Regulation on Public Electronic Communications Service Provision, approved by ANRCETI Administrative Board Decision no. 48 of 10.9.2013, in force since February 15, 2014.
