National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

ANRCETI is announcing that the Agenda of May 7 Administrative Board meeting has been supplemented with an additional draft (doc. in state language) decision - on modification and amendment of Procedure (doc. in state language) for transfer of licenses for the use of limited resources in the provision of public electronic communications networks and services. The meeting is scheduled for 14.00, at ANRCETI office.

The Explanatory Note (doc. in state language) to the draft document shows that it was developed due to the need of bringing the Procedure for transfer of licenses for the use of limited resources (Administrative Board Decision no.08 of 25.02.2010) in line with the new provisions of the Competition Law no. 183 of 11.07.2012 and subsequent regulations issued by ANRCETI.

ANRCETI proposes a new version of sub-section 3) section 9 of the Procedure: "the competition authority's decision declaring the operation of economic concentration compatible with the competitive environment, in the case of network providers eligible for the turnover referred to in Art. 22 (1) of the Competition Law". According to the Procedure, ANRCETI requires this decision of the competition authority for the cases when licenses for the use of radio frequencies / channels are transferred.

The second amendment proposed by the authors of the draft document provides for supplementing list of documents submitted by applicants to ANRCETI, in cases when licenses for the use of numbering resources are transferred. In this situation, the transferee has to submit a copy of the Agreement (doc. in state language) for the organization, operation, management and maintenance of the centralized database for the implementation of number portability, signed between the transferee and the CDB Administrator, as well as copies of the documents confirming the fact of payment (by transferee to the transferor) of fees for the use of numbering resources for the remaining period of the transferring year, as applicable, and/or a fee for the issuance of a license for the use of radio frequencies / channels assigned.

The draft decision has been subject to public consultations March 28 – April 12, 2013. The proposals as to the draft document are available on ANRCETI web page in the Synthesis of Recommendations (doc. in state language).
