Pursuant to the provisions of Law no. 28/2016, as well as analyzing the situation under all factual and legal aspects, ANRCETI developed and adopted a series of decisions regarding the establishment and publication of access conditions by the relevant public entities, which are obliged to:
- establish and publish within 30 days from the date they receive the decision, the access conditions, according to the provisions of Art. 7 in correlation with Art. 9 of Law no. 28/2016;
- send to ANRCETI, in copy, the access conditions, within 3 working days from the date of their publication, according to Art. 8 para. (1) of Law no. 28/2016;
- admit of no acts that could disrupt the services provided by electronic communications providers through the physical property/infrastructure that is owned (administered) by the administration holder and to which the providers have already achieved access based on previous contractual/administrative relationships [especially, not to violate the supplier's rights provided for in Art. 4 para. (5) lit. b) and letter e) of Law no. 28/2016: (i) by disconnecting the equipment/public electronic communications network from the power source and (ii) by limiting/blocking the provider's access therein].
