The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) approved, by Administrative Board Decision no. 55/2022, the Program for Elaboration of Normative acts for 2023. This document specifies the regulatory measures that ANRCETI is planning to implement next year, and the deadlines for their drafting and adoption.
The program provides for the development of 25 draft normative acts, most of which are aimed at the ex ante regulation of the relevant markets for public electronic communications services, as well as the organization of competitions regarding the issuance of licenses for the use of radio frequencies and channels.
Thus, ANRCETI will conduct the analysis of the relevant markets (Market, 3, 4, 5, 7) in the VI round. The purpose of this analysis is to ascertain the existence of effective competition on those markets and review, as appropriate, the ex ante regulatory measures in order to maintain, modify or withdraw some obligations previously imposed on providers designated with significant market power.
ANRCETI also plans to develop and approve the necessary documents for organizing:
- the auction for the issuance of licenses for the use of radio frequencies/channels in the 2100 MHz frequency band for the purpose of providing terrestrial cellular mobile electronic communications networks and/or services;
- the auction for the issuance of licenses for the use of radio frequencies/channels in the 174-230 MHz frequency band for the purpose of providing publicly available electronic communications networks and services in a digital broadcasting system;
- the auction on the issuance of licenses for the use of radio frequencies/channels in the frequency band 470-694 MHz for the purpose of providing public networks with regional coverage and electronic communications services in the terrestrial digital television system.
According to the Program, in 2023 ANRCETI will amend the Regulation on Provision of Publicly Available Electronic Communications Services, the Procedure for Numbering Resources Administration, the General License Conditions for the use of numbering resources, the General Authorization and Licensing Regime in the field of electronic communications , the Forms of statistical reports for providers of publicly available electronic communications networks and/or services, etc. in order to update them.
