National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces for Wednesday, March 31, 2022, at 10.00, a public meeting of the Administrative Board to examine and submit for approval the following draft decisions:

1) Draft Administrative Board decisions amending the special ex-ante obligations imposed on fixed and mobile voice network providers on the markets for voice call termination in fixed and mobile networks.

According to the Informative Note, these draft decisions were prepared based on Art. 6 (2) of the Law on Electronic Communications no. 241/2007, in order to implement the Agreement between the Government of the Republic of Moldova and the Government of Romania, on the reduction of tariffs for the provision of international roaming services and international calls between the two countries, signed in Chisinau on February 11, 2022, approved by Government Decision no. 103/2022.

The draft decisions were publicly consulted in the timeframe 28.02.2022 - 21.03.2022. ANRCETI received comments and proposals from JSC Orange Moldova, JSC Moldcell, JSC Moldtelecom and JSC Arax Impex. ANRCETI's opinion is presented in the Summary of Recommendations for the two draft decisions.

2) Draft Administrative Decision amending Decision no. 126 of 02.06.2009 on establishing categories of radio frequencies and radio equipment, the use of which is allowed without obtaining a license or technical permit.

According to the Informative Note, this draft document was prepared based on art. 26 (12) b) of the Law on Electronic Communications no. 241/2007. The modification of Decision no. No 126/2009 is necessary for the harmonization to Decision ECC / DEC (20) 01 and is in line with the provisions of ERC Recommendation 70-03 with reference to the use of short-range devices, given that the Republic of Moldova is a member of CEPT.

The draft Decision was publicly consulted in the timeframe 10.02.2022 - 03.03.2022. ANRCETI received no proposals or objections to this document.

ANRCETI also requested that interested stakeholders, the National Radio Frequency Management Service and the Ministry of Infrastructure and Regional Development provide an approval this draft decision. Both stakeholders informed ANRCETI they had no objections or proposals.

3) Draft Administrative Board Decision amending Decision no. 54/2017 on the general authorization and licensing regime in electronic communications. According to the Informative Note, this draft decision was developed based on art. 9 (1) a) and art. 10 (1), a) of the Law on Electronic Communications no. 241/2007 and the Law on State Registration of Legal Entities and Individual Entrepreneurs, no. 220/2007, according to which the legal persons and the individual entrepreneurs consider themselves registered on the date the registration decision is adopted, as well considering that ANRCETI is connected to the SIEGEAP Information System and can obtain the registration data of the applicants. The draft Decision was under public consultation in the timeframe 10.02.2022 - 03.03.2022. ANRCETI received no proposals or objections to this document.

ANRCETI also requested that interested stakeholders, Ministry of Justice and Ministry of Infrastructure and Regional Development approve the draft decision. Ministry of Infrastructure and Regional Development informed ANRCETI thay had no objections or proposals.

4) Draft Administrative Board Decision amending Decision no. 8/2013 on the approval of Technical and Commercial Conditions for the Implementation of Number Portability in the Republic of Moldova.

According to the Informative Note, this draft document was developed based on Art. 9 (1) a) of the Law on Electronic Communications no. 241/2007 and at the providers’ request, taking into account developments in electronic communications technologies, in particular the fact that the terminal equipment with incorporated eSIM cards that does not need the introduction or replacement of a physical SIM card is already available to end-users on the market, and is connected to electronic communications networks., as well as having regards to the modifications operated in this respect, by means of Administrative Board Decision no. 23 of 22.07.2021, to the Regulation on the Provision of Publicly Available Electronic Communications Services, approved by Administrative Board Decision no. 48 of 10.09.2013.

The draft document was publicly consulted in the timeframe 10.02.2022 - 03.03.2022. No proposals and objections to the project were received.
