ANRCETI ANNOUNCES PUBLIC CONSULTATION OF DRAFT ANALYSIS OF MARKET FOR TRAFFIC TRANSIT IN PUBLIC TELEPHONE NETWORKS AND EX-ANTE REGULATORY MEASURES

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces public consultation of draft analysis of the market for traffic transit in public telephone networks (Market 9) and the draft decision on preventive regulatory measures. The deadline for submitting recommendations for the documents under consultation is 15 November 2021.

The draft documents were developed in accordance with the provisions of art. 57 and art. 61 paragraph (1) of the Law on Electronic Communications no. 241/2007, which require that ANRCETI identifies relevant markets and performs analyses on these markets, within 3 years after setting previous regulatory measure on those markets, in order to establish the existence of effective competition on those markets.

In the Information Note to the draft documents it is stated that as a result of the analysis, ANRCETI concludes that Market 9 is still susceptible to preventive regulation, and JSC "Moldtelecom" continues to have significant power in this market. Thus, ANRCETI came to the conclusion that there is a need to maintain the special ex-ante obligations, previously imposed on this provider.
