National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces, for March 29, 2023, at 16:30, the meeting of the Administrative Board, to examine and subject for approval three decisions, on the following three issues:
1. Ex-ante regulatory measures for the market of end-users' access to a fixed post in the public telephone network (Market 1);
2. Ex-ante regulatory measures for the market of call termination on individual public telephone networks provided at a fixed location (Market 3);
3. Ex-ante regulatory measures for the market of voice call termination on individual mobile network (Market 7).

Following the completion of the analysis of Markets 1, 3, and 7, ANRCETI makes final versions publicly available.

The draft documents were publicly consulted in the timeframe February 27 - March 20, 2023, on ANRCETI official website www.anrceti.md.

According to the Informative Note to the first draft document, ANRCETI concluded that this market no longer meets the three-criteria test and proves to be no longer susceptible to preventive regulation. Therefore, it is proposed to withdraw the special ex-ante obligations previously imposed on "Moldtelecom". The comments and proposals received from interested parties were included into the Summary of Recommendations No. 1.

In the Informative Notes to the second and third draft decisions, it is mentioned that both Market 3 and Market 7 remain susceptible to ex-ante regulation, all fixed-line and mobile phone providers have significant power in these markets, but their influencing power is different. Following the analysis carried out in round 6, ANRCETI proposes to extend the special ex-ante regulatory measures for Markets 3 and 7 over the calls originating from numbers in the European Union (EU) and the European Economic Area (EEA), to grant them tariff treatment similar to national ones. The proposals ANRCETI received for the draft documents are available in the Summary of Recommendations No. 2.
