Today, May 20 2020, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI), published on the website www.anrceti.md, for public consultations, the draft analysis of market for the access of end-users (individuals and legal entities) to the fixed location of public telephone network (Market 1) and the draft ANRCETI Board Decision on the measures to regulate this market. The deadline for submitting recommendations on these documents is 12 June 2020.
The draft documents under public consultation were developed in accordance with Law on Electronic Communications no. 241/2007, according to which ANRCETI identifies relevant markets and performs their analysis within 3 years after establishment of a previous measure, in order to determine whether the relevant market is sufficiently competitive. Following the performed analysis, ANRCETI has the right to impose, maintain, modify or withdraw the previously established special ex-ante obligations.
According to the Explanatory Note accompanying the documents under consultation, the test of the three criteria showed that this market is still subject to ex ante regulation and that the geographical boundaries of the market have been determined as national territory. Also, following the 5th round of the Market 1 analysis, in which ANRCETI examined a series of criteria deemed appropriate for the given market, its authors proved that JSC “Moldtelecom” continues to have significant power over this market.
Based on the conclusions set out in the Market 1 Analysis, the authors propose to maintain the special ex-ante obligations, previously imposed on JSC Moldtelecom, by the Administrative Board Decision no. 12/2012.
