In 2022, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI), in its role of a body empowered to ascertain contraventions in the fields of its competence, sanctioned 46 natural and legal persons for committing contraventions, according to the provisions of the Contravention Code of the Republic of Moldova no. 218/2008 (Code no. 218/2008).
According to the prepared reports, ANRCETI found that 29 natural and legal persons breaching the rules for the protection of electronic communication lines and installations. Those persons were fined, according to Art. 250 para. (6) of Code no. 218/2008, from 30 to 240 conventional units (from 1500 to 12000 lei).
Other 10 natural and legal persons imprudently damaged the lines, installations, electronic or postal communications equipment, for which they were fined, according to art. 255 para. (1) from Code no. 218/2008, from 10 to 100 conventional units (from 500 lei to 5000 lei).
Other contraventions detected by ANRCETI were: non-compliance with the general authorization conditions by providers of electronic communications networks/services (art. 247 paragraph (1) of Code no. 218/2008), impeding ANRCETI's activity (art. 259²), use of radio frequencies/channels without a license and technical permit, (art. 248 para. (1)), conducting construction works in the protection zones around lines, cables and electronic communications installations, without an authorization of the owner (art. 250 par. (7)). For these contraventions, the persons were fined from 30 to 300 conventional units (from 1,500 lei to 15,000 lei).
Overall, in the timeframe January - December 2022, as a result of contravention cases initiated by ANRCETI, total amount of 212,100 lei fines were applied. The amounts are collected to the national public budget.
