The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) is announcing for Thursday, October 1, 2015, at 14.00, a public session to review and adopt the Board decisions regarding ex-ante remedies on the market of wholesale network infrastructure access at a fixed location (market 4) and the market of wholesale broadband access (market 5). The session will take place at ANRCETI office (134, Stefan cel Mare, bd. 134, et. 5, Conference room).
The draft decisions and the analysis of markets 4 and 5 were subject to public consultations procedure on ANRCETI Web page in the timeframe 09.09.2015 - 23.09.2015. ANRCETI received no comments or recommendations on consulted documents.
ANRCETI Administrative Board Decisions had been developed under Art. 53 (1) of the Electronic Communications Act for the purpose of finding if these markets are effectively competitive and reviewing the regulatory remedies in view of imposing, maintaining, amending or withdrawing the ex-ante obligations imposed on electronic communications providers designated with significant market power.
According to the Explanatory Notes No.1 (Market 4) and No. 2 (Market 5), ANRCETI specialists ascertained that those markets are susceptible to ex-ante regulation and Moldtelecom continues to have significant power on these two markets.
The draft decisions proposed to be adopted provide for maintaining the ex-ante obligations, imposed on Moldtelecom, in connection with its significant market power on market 4 by ANRCETI Administrative Board Decision no.56 of 26.09.2013 and market 5 by ANRCETI Administrative Board Decision no.6 of 28.03.2011, with amendments made by ANRCETI Administrative Board Decision no.57 of 26.09.2013.
