Public Debates on Draft Standard Contract for Access of Public Electronic Communications Providers on Public or Private Property

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) invites interested stakeholders, scheduled for Friday, July 1st, 10.00, to public debates on the draft (.pdf) standard Contract of access to public or private property for the construction (installation), maintenance, removal, replacement, transfer or retrofitting of public electronic communications networks or infrastructure elements. The document was under public consultation by means of ANRCETI official website in the timeframe May 25 – June 14, 2016. The meeting will be held at ANRCETI premises (134, Stefan cel Mare, bd. 5th floor, Conference Room).

ANRCETI invites public electronic communications network and services providers, representatives of local public administration authorities, building, property and infrastructure owners, other stakeholders to attend the meeting. The purpose of the debates is exchange views on the comments and recommendations received from several providers on a number of provisions of the draft document under public consultation.

ANRCETI drafted the standard contract under the provisions of the Law on access to the properties and shared use of infrastructure associated to public electronic communications networks, no. 28 of 03/10/2016, (hereinafter - Law No.28/2016), which provides for an optional standard form for this agreement, namely, a standard contract, which prescribes the conditions of access – the right of a public electronic communications network provider, authorized under the Law on Electronic Communications, to have access/use state public or private property, including that of administrative-territorial units.

The draft standard contract prepared by ANRCETI is recommendatory and aims mainly at structuring and informing about the rights and obligations of providers as regards access to public and private property. The contract reflects the provisions of Law No.28/2016 and includes, among others, provisions relating to the rights and obligations of the parties to the contract, the duration of the contract and the arrangements for its termination, tariffs and methods of payment, etc.

According to Law No.28/2016, the standard contract of access to public or private property for the construction (installation), maintenance, removal, replacement, transfer or retrofitting of public electronic communications networks or associated infrastructure elements shall be published by ANRCETI on its official website within three months from the date this law entered in force (July 15th, 2016).
