National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announced for Thursday, June 30, 14.00, a public meeting to review and submit for approval the draft (.pdf) ANRCETI Administrative Board Decision approving amendments to the Annex of ANRCETI Administrative Board Decision no. 74 of 29.12.2015, approving ANRCETI Program of Regulatory Acts Development for 2016. The meeting will take place at ANRCETI premises (134, Stefan cel Mare bd., 5th floor, Conference Room).

The draft document was subject to public consultation procedure by means of ANRCETI official website in the timeframe May 23 - June 10. ANRCETI received recommendations from a single provider – LLC "Arax-Impex". They were rejected by ANRCETI, for a number of reasons presented in the summary of recommendations – a document published on ANRCETI official website.

The Explanatory Note to the draft decision states that it has been developed in order to prepare the secondary legislation for the implementation of the Law on access to properties and shared use of infrastructure associated with public electronic communications networks, no. 28 of 03.10.2016 (hereinafter - Law no.28/2016) and Law on Postal Communications no. 36 of 03.17.2016 (hereinafter - Law no.36/2016), by which ANRCETI was empowered with regulatory duties for those sectors.

In terms of the implementation of Law No.28 / 2016, the draft document specifies the timeframes for the development and approval of the following regulatory acts: standard contract for access on public or private property for the construction (installation), maintenance, replacement, transfer or retrofitting electronic communications networks or infrastructure elements, the methodology for calculating the maximum fees for the right of access to public property and/or shared use of physical infrastructure, the format of information required by ANRCETI for the development of a digital inventory of public electronic communications networks and associated infrastructure elements.

As for the enforcement of Law nr.36/2016 the draft document establishes the timeframes for the development of the next set of normative acts: Methodology of tariff calculation for postal services within the scope of universal postal service, Methodology of cost allocation for reserved and non-reserved services, Mechanism of financing and compensating the net cost of providing postal services within the scope of universal postal service. Regarding the principles and rules for the use of the public postal network of the universal service provider, the draft document specifies that ANRCETI will develop such a regulatory act depending on market demand.

Meanwhile, ANRCETI proposes to extend the terms of developing some regulatory acts included in ANRCETI Administrative Board Decision no. 74 of 29.12.2015 for the second half of the year.
