The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) published on its website for public consultation draft (.pdf) ANRCETI Administrative Board Decision on establishing the method of application and the format of information needed to prepare the detailed inventory of public electronic communications networks and associated infrastructure elements. The consultation will last through July 18, which is the deadline for submitting recommendations on the draft document.
The draft decision was developed pursuant to the Law on access to properties and shared use of infrastructure associated with public electronic communications networks no. 28 of 10.03.2016 (hereinafter – Law no.28/2016), which requires that all providers of public electronic communications networks annually update and submit to ANRCETI by July 1st, comprehensive information about the nature, availability and geographic location of the electronic communications networks and associated facilities under their operation. To enforce the provisions of Art. 21 – 23, Law no.28/2016, ANRCETI has the task to prepare, based on the provided information, a detailed digital inventory of public electronic communications networks and associated infrastructure elements.
According to Art. 24 (3) of Law no.28/2016, the mentioned information shall be provided to ANRCETI within 12 months from the date an ANRCETI Administrative Board Decision is published for this reason, which prescribes the method of application and the format of the information to be submitted by providers.
According to the Explanatory Note, the document was drafted under the guidance of the experience gained by regulators in several European Union countries (Germany, Portugal, Lithuania, Romania, etc.) who have already implemented or are in the process of implementing a digital inventory of public electronic communications networks and associated infrastructure elements.
The draft document includes the definitions of network elements and associated infrastructure elements, the format of the information to be submitted to ANRCETI, terms and deadline. The Annex provides the list of information and the basic parameters of network elements and associated facilities to be presented to ANRCETI.
