The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces that starting from October 29, 2016 natural or legal persons, registered as entrepreneurs in Moldova, who intend to provide postal services, can enter the market by going through a simple procedure of notifying about the intention to provide postal services. This simplified market entry procedure, called general authorization, will be implemented by ANRCETI pursuant to the Law on Postal Communications No.36 of 17.03.2016 (hereinafter - Law 36/2016).
Under the law, the postal service providers at the time of entry into force of Law 36/2016 (April 29, 2016), who wish to continue to provide postal services, need to notify ANRCETI about their intention before November 29, 2016. So far, those providers have been operating on basis of licenses for activity in postal sector.
Interested stakeholders are invited to notify by filling out the standard form of notification downloadable from ANRCETI official website at the following link: http://en.anrceti.md/cp_procedura_notif. The form requires certain information to be provided by the person intending to enter the postal service market (data necessary to identify the provider and communication with him, the services that the person intends to provide and the general description of his postal network, estimated date for starting the activity).
Applicants may choose from 10 types of postal services outside the scope of the universal postal service, included in the form, the range of services they want to provide, while the State company "Posta Moldovei", designated by Law 36/2016 as universal postal service provider, – the services within the scope of universal postal service established by the same law.
The notification and the documents for registration of the applicant as entrepreneur is delivered to ANRCETI headquarters (134 Stefan cel Mare bd., MD-2012, Chisinau) in one of three ways: by submitting it personally or by an authorized representative, upon signature; by postal service with confirmation receipt or as an electronic entry, with authentic electronic signature.
ANRCETI, within 15 days from the notification data, issues a standard certificate, confirming the notification, the registration of the applicant in the public Register of postal service providers and the rights and obligations of the postal service provider. The general authorization regime gives the right to provide postal services and to enter agreements for the use of public postal network.
The preparation of documents under the general authorization regime is performed by ANRCETI free of charge and the right to provide postal services is valid without any time limit, except as provided by Law 36/2016.
