National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The Administrative Board of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) has placed on its website, for public consultations, the draft (doc. in state language) Administrative Board decision regarding the procedure for organizing and conducting a tender to select the administrator of the centralized data base for the implementation of number portability in the Republic of Moldova. The consultations are scheduled for December 8, 2011, this being the deadline for submitting recommendations.

The draft document was developed by ANRCETI in accordance with the provisions of the legislation in force and the Program (doc. in state language) for number portability implementation in the Republic of Moldova for 2011 – 2013. According to the Explanatory Note (doc. in state language), this document will serve as a tool in the process of organizing and conducting this tender. It provides for the general principles, terms and conditions for the tender to select the entity responsible for the development, operation, administration and maintenance of the centralized data base for number portability, will coordinate and control the process of porting telephone numbers.

The draft document is structured in 11 chapters and 105 sections. According to it, the centralized database administrator will be selected through an open international tender, by means of a comparative selection procedure. The tender will take place in two stages. The first step (pre-selection of candidates to identify the tender participants) will take place on the basis of the eligibility criteria set forth in the terms of reference. It will open to all candidates who submitted applications to participate in the tender, under the terms and conditions set out in the tender announcement. The shortlisted candidates will take part in the second stage (review, evaluation and comparison of bids).

The tender is open for legal entities from the republic of Moldova and from abroad or civil societies/associations of legal entities from Moldova and/or from abroad founded for the purpose of submitting a joint application and bid. The draft document specifies the categories of legal entities and natural persons - involved in the market for fixed and mobile telephone networks/services from the Republic of Moldova that have the right to bid.

ANRCETI, as tender organizer, shall establish, by a decision, the tender commission and shall designate the secretary. The draft document sets forth the criteria for designating the members of the tender Commission, its functions, the tender procedure, the minimum requirements and the rights of the candidates, the requirements for the Terms of Reference and other tender documents, the responsibilities and obligations of the parties involved in the tender and the procedure for solving the disputes that may arise in this process
