ANRCETI approved new version of regulations on general authorization regime and license issuance for use of numbering resources

The National regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) updated the classified list of the types of electronic communications networks and services subject to general authorization, the conditions of this procedure, as well as the procedure of license issuance for the use of radio frequencies and/or channels and numbering resources. The updated sections are provided in the new version of the Regulation on General Authorization Regime and License Issuance for Use of limited resources in the provision of public electronic communications networks and services.

The Regulation was approved by the Administrative Board on Tuesday, December 21 and will become effective on the date it is published in the Official Monitor. The document comprises all the aspects related to the general authorization and licensing in electronic communications, which have been brought in line with the new requirements, however without establishing new legal norms and changing the core of the previous Regulation.

The new version of the Regulation provides for the types of electronic communications networks and services, conditions for their provision, the procedure for general authorization and licensing, the sample forms for the license, notification and informative declaration. The document is structured in four chapters: General Provisions, General Authorization Regime, Licensing regime, Final Provisions, being supplemented with eight annexes, containing the forms of the documents, needed to pass through the general authorization and licensing procedure.

According to the Regulation, currently the general authorization regime is applied for 6 types of public networks (terrestrial networks with access at fixed location, terrestrial networks for electronic communications distribution and transportation, cell mobile radio networks, terrestrial radio broadcasting networks, satellite networks) and six types of public electronic communications services (telephone services, call transportation services, leased line services, data transmission, Internet access and broadcasting programs services).

ANRCETI has been applying the general authorization regime for the provision of public electronic communications networks and/or services since September 15, 2008. This procedure simplified market entry and reduced costs incurred by entrants. The procedure provides that the applicant needs to submit to the Agency an notification stating his intent to provide public electronic communications networks and/or services at least 7 days before launching the activity. The Agency, within 7 days from the date of submitting the notification, issues an informative declaration, confirming the notification and his inclusion in the Public Register of Providers of Electronic Communications networks and Services. This being completed, the applicant becomes entitled to run on the market.

Since the general authorization regime has been introduced, the Agency authorized 376 applicants for the provision of electronic communications networks and services.
