The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) placed on its website, for public consultation, the draft (word: pdf: ) Administrative Board Decision approving the Regulation on Procedure for settling disputes falling under the competence of ANRCETI, which provides for the revision of the current Regulation on Dispute Resolution Procedure in electronic communications. The consultations will last until July 8, 2016, which is the deadline for submitting recommendations on the document.
The central objective of revising the current Regulation is the need to enforce the provisions of the Law on access to the properties and shared use of infrastructure associated with public electronic communications networks, no. 28 of 03.10.2016 (hereinafter - Law no. 28/2016) and Law on postal communications no. 36 of 03.17.2016 (hereinafter - Law no. 36/2016), which empowered ANRCETI to settle disputes in matters covered by those laws.
The legal basis for drafting the Regulations is the provisions of the two above-mentioned laws, as well as of Law on Electronic Communications no. 241 of 15.11.2007, as subsequently amended and supplemented, Law on Normative Acts of Government and other central and local public administration authorities no. 317-XV of 18.07.2003.
According to the Explanatory Note to the document, the revised Regulation aims to create a simple and clear procedure that will reinforce the conviction of providers and users that the problems they face in contracting electronic communications and postal services, in establishing relations of access to properties and shared use of infrastructure associated with public communications networks can be resolved quickly and efficiently.
