National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) has launched public consultations on Draft Methodology for calculation of the maximum fees for the right of access to public property and/or infrastructure sharing and the final Analysis of the regulatory impact of this document. The consultation will last through July 6, which is the deadline for recommendations.

According to the Explanatory Note, initially, ANRCETI developed the preliminary Regulatory Impact Analysis (RIA) of the Methodology, which was publicly consulted on May 6 – 20, 2016, on ANRCETI website. The comments and recommendations received by ANRCETI on this document were considered for the development of the final version of the Methodology and the final Regulatory Impact Analysis thereof.

At the second stage, the preliminary RIA and the summary of recommendations received by ANRCETI were examined by the Working Group of the State Commission in charge of regulating entrepreneurial activity. The Commission supported the document, with then recommendation to improve the draft Methodology and the RIA at the final stage, taking into account the feedback provided by the Working Group expert.

At the third stage, both documents are subject to public consultations, after which ANRCETI will finalize and submit them for consideration to the Working Group of the State Commission in charge of regulating entrepreneurial activity. If necessary, ANRCETI may hold public hearings or working meetings with the stakeholders to clarify their positions and proposals made during the public consultation of the two projects.

The draft Methodology was developed in accordance with the Law on access to the properties and shared use of infrastructure associated with public electronic communications networks No. 28 of March 10, 2016 (hereinafter - the Law no.28 / 2016). That law stipulates that the maximum charges for the right of access public properties and/or shared use of physical infrastructure shall be determined based on a calculation Methodology developed by ANRCETI and approved by the Government.

According to Law No.28/2016, the public or local authorities, other public institutions and any other entities that manage public buildings, state or municipal enterprises administrators of technical infrastructure units and owners of the right of common property administration, including from condominium, based on the methodology above, will set tariffs for the access of electronic communications providers on public property and shared use of physical infrastructure.
