National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) is inviting fixed and mobile telephone operators, other interested persons, to attend the public hearings on draft Administrative Board Decisions on imposing special obligations to providers with significant market power on the markets for voice call termination on individual fixed telephone networks (market 3) and for voice call termination on individual mobile telephone networks (market 7). The hearings are scheduled for Friday, December 17, 10.00, at ANRCETI office (134, Ştefan cel Mare bd), 5th floor, Conference Hall.

The draft decisions were available on the Agency Web site for public consultations in the timeframe November 18 - December 4, 2010. All the commentaries and recommendations provided by stakeholders on the issue have been incorporated into the synthesis of recommendations (doc. in state language), currently available on the Web site. The document also contains ANRCETI’s viewpoint concerning every recommendation included in the synthesis.

During the public hearings, ANRCETI representatives will inform the stakeholders on the objections and recommendations provided by operators during the joint sessions, held at ANRCETI office last week.

The draft decisions were developed pursuant to the Law on Electronic Communications and based on the Administrative Board Decisions on designation of providers with significant market power on the market for voice call termination on individual fixed telephone networks and those with significant market power on the market for voice call termination on individual mobile telephone networks of 18.11.2010. According to the mentioned decisions, the Board designated 17 providers (JSC „Moldtelecom”, JSC „Riscom”, LLC „Sun communications”, LLC „Arax-Impex” etc.) with significant market power on the market for voice call termination on individual fixed telephone networks and 3 providers (JSC „Orange Moldova”, JSC „Moldcell” and JSC „Moldtelecom”) - with significant market power on the market for voice call termination on individual mobile telephone networks.

In the two draft Decisions, ANRCETI, pursuant to the Law on Electronic Communications, established a number of special ex-ante obligations, meant to contribute with solutions to competitive problems on the given markets. These obligations pertain to ensuring the access to the networks and/or interconnection, transparency of access and/or interconnection services, admitting of no discrimination against other providers, cost control and cost-oriented prices, separate cost accounting.
