National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The Administrative Board of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) is announcing a meeting, scheduled for Thursday, November 18, 14.00, to decide on the issue of draft decision approval for designation of providers with significant market power on the market for voice call termination on individual fixed telephone market (market no. 3) and for voice call termination on individual mobile telephone market (market no. 7). The meeting is public and will take place at ANRCETI office, 5th floor, conference room. (bd. Stefan cel Mare, 134).

ANRCETI will also make publicly available the final market analysis reports for the market of voice call termination on individual fixed networks (analysis (doc. in state language) of market 3) and voice call termination on individual mobile networks (analysis (doc. in state language) of market 7).

The draft decisions were developed pursuant to the provisions of the Law on Electronic Communications and in accordance with ANRCETI Administrative Board Decisions no. 21 and no. 20 of 15.07.2010 on identification of the market of voice call termination on individual fixed and, accordingly, mobile networks.

The draft decisions on the two markets were subject to public consultations on the agency’s Web site, on October 13 – November 1, 2010. The submitted proposals – from companies JSC „Moldtelecom”, LLC „Arax-Impex”, JSC „Orange Moldova”, JSC „Moldcell” and the National Agency for Competition Protection – were reflected on the synthesis (doc. in state language) of recommendations, available on the Web site.

The draft decisions are based on the conclusions of the analyses of the two markets. The analyses were conducted by ANRCETI specialists under the support of the consultants engaged in the technical assistance project offered to ANRCETI by the European Bank for reconstruction and development.

According to the Explanatory Note (doc. in state language), the analysis proved there are 17 providers with significant market power on the market of voice call termination on individual fixed networks and 3 providers with significant market power on the market of voice call termination on individual mobile networks.

The authors of the Explanatory Note specify that the analyses were carried out according to the criteria laid down in Annex A to the Regulations on Identification and Analysis of relevant electronic communications markets and designation of electronic communications network and / or service providers with significant market power, and also based on the situation on the given markets.
