Results of Planned Inspections Performed by ANRCETI in Qr IV 2015

In the timeframe October – December 2015, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) carried out 14 planned inspections of the activity of electronic communications providers. Within the inspections, ANRCETI experts verified providers’ compliance with the legal provisions in force governing the electronic communications sector. The inspections took place according to the schedule of inspections, developed under the provisions of the Law on State Control on Business Activity and placed on ANRCETI Web site.

As recorded by the inspection documents issued by ANRCETI, breaches were found in the activity of most inspected providers. Most frequent breaches referred to: inconsistency of the service provision contract with the legal provisions in force, non-transparency of service provision conditions, failure to inform ANRCETI about any changes of data provided in the notification under the general authorization regime, failure to submit statistical reports to ANRCETI or their submitting beyond the deadline.

Following the inspections, ANRCETI issued prescriptions to providers, requiring them to remedy the breaches within fixed deadlines and prevent future violations – noncompliance with the obligation to inform end users and to include in contracts the minimum clauses required by law. Some providers complied to ANRCETI’s requirements in due time, others are expected to comply by the end of January 2016.

ANRCETI experts provided advice to the inspected providers in terms of legislation, including in quality of service, security of public electronic communications services and user protection, focusing on the need to ensure transparency of tariffs and service provision conditions, compliance with the obligation to inform users, to adjust the standard contractual clauses to the requirements of normative acts, etc.

In the timeframe January – March 2016, ANRCETI plans to carry out 10 planned inspections. The providers to be inspected will be nominated in the Schedule of inspections for qr. I 2016, placed on ANRCETI official Web page.
