Today, The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) published draft (doc. in state language) Administrative Board Decision on approving the Program of Regulatory documents to be issued in 2014 on its Web page, for public consultations. The consultations will last through November 25, 2013, this being the deadline for recommendations relevant for this document.
The program was developed under sections 17 and 18 of the Regulation on the procedures to ensure transparency in the decision-making process, approved by Government Decision no. 96 of 16.02.2010. This program aims to facilitate stakeholder’s access to information on the new regulatory acts that ANRCETI will approve next year, thus facilitating their participation in the decision-making.
The proposals for this program are mostly focused on competition promotion and protection of users’ rights. For this purpose, ANRCETI will start the third cycle of relevant market analysis for markets 2, 3, 7 and 9 for their identification as susceptible ante regulation and designation of SMP providers. As well, ANRCETI intends to add one more market to the list of relevant markets – the mobile retail market, which will be subject to analysis in order to identify its susceptibility to ex-ante regulation and need to designate providers with significant market power.
Another important issue for 2014 is to develop the regulations on spectrum use. In this respect, ANRCETI intends to elaborate and approve the Terms of Reference for auctioning the 800 MHz, 900 MHz and 1800 MHz spectrum licenses and the special license conditions for the use of this spectrum. Also, ANRCETI will issue a decision to declare technological neutrality in 800 MHz, 900 MHz, 1800 MHz and 2100 MHz frequency bands.
ANRCETI is also planning to develop and approve the Guidelines for the provision of provisional mobile services at demonstrations and public events, the Procedure of allocation and use of national short numbers of economic nature from number range "1" and the Procedure for allocation and use of short codes SMS/MMS. In the same timeframe, ANRCETI will also adopt a number of amendments to the Regulation on verification procedure in electronic communications.
In order to remedy the problems identified in the implementation of a number of Administrative Board Decisions and bring them in line with the technological developments and the evolution of the electronic communications market, ANRCETI will amend to the following regulations: Guidelines on the implementation by JSC "Moldtelecom" of separate accounting in the internal accounting systems, Procedures for management of signaling point codes, instructions on issuance of technical permits for radio stations.
According to the motivation note (doc. in state language), the draft Program is in accordance with the ANRCETI Plan of Activity for 2014.
