National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) required that JSC „Moldtelecom” modify and amend the Reference Interconnection Offer, including the standard Interconnection Agreement, to present them to ANRCETI and make them publicly available on its Internet page. This obligation is prescribed by an ANRCETI Administrative Board Decision (doc. in state language) on imposing modifications to the Reference Interconnection Offer of JSC „Moldtelecom”, published in the Official Gazette on June 8, 2012.

The adoption of such a decision was conditioned by non-compliance of JSC „Moldtelecom” with the provisions referring to interconnection, from ANRCETI Board Decisions no. 60 and no. 79 (docs in state language) of 23.12.2010 on imposing special ex-ante obligations on JSC “Moldtelecom” given its SMP on the markets for voice call termination in its individual fixed and mobile network and Decisions no. 27 and no. 28 of 01.11.2011 regarding the obligations of this provider on the markets for call origination at fixed locations in the public fixed network and traffic transit in public telephone networks.

Among the obligations imposed to JSC „Moldtelecom”, designated by ANRCETI as an SMP provider on the aforementioned markets are: cost-orientation of interconnection tariffs, ensuring transparency, non-discrimination of other providers on the market, keeping separate accounting.

Through its new decision, ANRCETI required that JSC „Moldtelecom” bring its Reference Interconnection Offer and standard Interconnection Agreement into line with the obligations this SMP provider has. The modifications to the standard Interconnection Agreement provide for a series of new clauses, including the terms for payment of bills for national and international incoming traffic issued by the parties.

ANRCETI specialists consider that the Administrative Board Decision regarding the interconnection with the public fixed/mobile networks of JSC „Moldtelecom” will contribute to the improvement of the existing situation on the interconnection market, which factor will enhance competition between providers of public electronic communication services.
