National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The Administrative Board of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) is inviting stakeholders to a public session, to be held on September 15, 14.00, to review and approve the draft decisions on designation of JSC „Moldtelecom” as a provider with SMP on two wholesale markets: market for the provision of terminating segments (market no.6, doc. in state language) and market for the provision of trunk segments (doc. in state language) of leased lines (market no.8), regardless of the technology used to make leased or reserved capacity available. The session will take place at ANRCETI office, 5th floor, Conference Room, (134, Stefan cel Mare).

ANRCETI has also placed on its web page the final versions of the detailed analysis for markets no. 6 and no. 8 (docs in state language). The decisions and the analysis were drafted pursuant to Art. 9 (1) k), l) and m) and art. 51 of the Law on Electronic Communications and the Regulations on identification and analysis of relevant electronic communications markets and designation of SMP providers.

The mentioned draft decisions were subject to public consultations on July 5 – August 1, 2011, on ANRCETI Web page. JSC „Moldtelecom” provided commentaries and recommendations on both draft documents, which were included in the Review of Recommendations no.1 and no.2 (docs in state language), both available on ANRCETI Web page.

According to the Explanatory Notes no. 1 and no. 2 (docs in state language), supplementing the draft decisions, the detailed analysis of the two markets proved that JSC „Moldtelecom” has significant market power on both markets - no.6 and no.8. Based on the analysis, the regulator identified the significant market power of the incumbent operator on both markets.

The market analysis also identified the risks of competition distortion on the two markets, given the significant market power of JSC „Moldtelecom”, as well as the special ex-ante obligations to be imposed on this provider in order to avert those risks and to remedy the competition problems on the two markets. Subsequently, ANRCETI will draft and propose for public consultation the Board Decisions imposing special ex-ante obligations on JSC „Moldtelecom” given its significant market power on the afore-mentioned markets.
