National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The Administrative Board of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) is announcing (Tuesday, May 15, at 14.00), a public hearing session to review and approve the draft (doc. in state language) decision on imposing changes to the Reference Interconnection Offer (RIO) of JSC "Moldtelecom". The meeting will take place at ANRCETI office (134, Stefan cel Mare, 5th floor, office 501).

The Explanatory Note (doc. in state language) to the document provides the reasons for which the Agency intends to impose RIO modifications. The draft document was subject to public consultation on September 8 – 23, 2011, and to repeated public consultations – on April 9 – 25, 2012. JSC “Moldtelecom” provided comments and proposals on the document. These are included in the synthesis of recommendations (doc. in state language), available on ANRCETI website.

The RIO of JSC "Moldtelecom" was reviewed by ANRCETI in terms of its compliance with Administrative Board Decisions no. 60 and no. 79 (docs in state language) of 23.12.2010 on imposing specific preventive obligations on "Moldtelecom" in connection with the company’s significant market power on the market for voice call termination in individual fixed and mobile telephone network and Decisions no. 27 and no. 28 of 01.11.2011 on the obligations of this provider on the market for call origination at fixed locations and traffic transit in the public telephone network in telephone networks. Following verifications, ANRCETI found non-compliance of JSC “Moldtelecom” with some of the requirements of the mentioned Decisions. 

Taking into account this fact, as well as the complaints from providers LLC ”Starnet”, JV ”Sun Communications” LLC, LLC ”Arax-Impex”, JSC ”Riscom”, LLC ”Cartel-Sistem”, LLC „Net-Connect” on problems faced in the interconnection of their networks with the network of JSC ”Moldtelecom”, ANRCETI started the procedure of imposing RIO modifications.

The draft document contains a number of modifications and additions to the RIO and standard Interconnection Agreement of JSC „Moldtelecom”. It was developed according to the provisions of Art. 44 (2), Law on Electronic Communications, enabling ANRCETI to impose modifications to the RIO of SMP providers.
