Repeated consultations on Regulatory Impact Analysis (RIA) of Draft Regulations on Public Electronic Communications Service Provision to End Users

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) placed on its website, for public consultation, a preliminary Regulatory Impact Analysis (RIA - doc. in state language) of Draft Regulations on Public Electronic Communications Service Provision to End Users. The consultations will last through November 17, this date being the deadline for comments and recommendations. The preliminary RIA and the draft Regulation had been proposed for consultations in the timeframes 26.09.12 - 10.10.12 and 26.09.12 - 26.10.12. In that period ANRCETI received comments and recommendations from companies "Orange Moldova", "Arax Impex" and "Sun Communications".  At ANRCETI’s request, the Ministry of Economy and the Competition Council also provided their opinions on those two documents.

On November 7, ANRCETI hosted a joint meeting with the representatives of "Moldtelecom", "Orange", "Moldcell", LLC "Arax Impex" and JV "Sun Communications", who previously provided comments for the two documents under public consultations. Practically all the representatives of these companies came to the agreement that these Regulations are to be adopted. At the same time, the meeting decided to propose the preliminary RIA for repeated consultations on ANRCETI Web page, and further submit it to the Working Group of the State Commission for entrepreneurial activity regulation.

According to the authors of the preliminary RIA, these Regulations were drafted in order to adjust the secondary regulatory framework to the requirements of the Law on Electronic Communications and issue regulations concerning the provision and use of Internet access and audiovisual program retransmission services. They consider that the enforcement of these Regulations will raise the level of end users’ rights protection when dealing with providers of electronic communications services, will ensure the tariff transparency and the conditions for the use of services, as well as information of end users about all aspects of the service provision, on regular basis.    

The preliminary RIA specifies that ANRCETI will review and process the provided recommendations, and will organize, if need be, public hearings on the relevant recommendations.
