ANRCETI will issue licenses for one type of activity in information technology

As of November 10, 2010, the National Agency for Regulation in Electronic Communications and Information Technology (ANRCETI - www.anrceti.md) will start issuing licenses for a single type of activity in information technology: for services of development, implementation and ensuring the functionality of automated information systems of state importance, including software.

Licensing this type of activity is prescribed by Law No. 176 of 15.07.2010 to amend Law No. 451-XV of 30.07.2001 on regulating entrepreneurial activity by licensing, expected to enter in force on November 10, 2010.

Licenses for the mentioned type of activity may be requested by individuals or legal entities, duly registered in the Republic of Moldova as a company or organization, regardless of property type and legal form of organization, as well as by any individuals who may engage in some types of activities subject to licensing under other legislation.

The license is granted based on the applicant's request. ANRCETI Board takes a decision to issue the license within 10 days after the appropriate request has been filed in. The license is issued to the applicant within 3 working days from date the document confirming payment of license fee is received. The fee, as established by law, is 2500 lei, a sum that fully goes to the state budget.

Simultaneously with the license, the applicant receives license terms. They prescribe the obligations to provide relevant services, the rights and responsibilities of the license holder. The license terms were approved by the ANRCETI Administrative Board Decision (doc. in state language) No. 33 of 04.11.2010.

The license is valid for 5 years and may be extended, for as long, under the same conditions.

To date, the Agency has issued, pursuant to the mentioned Law, licenses for two types of activity in information technology: (a) for services of design, development and implementation of automated information systems and resources of state importance and insuring their operation and (b) for services of development, maintenance and implementation of software and information systems of state importance. Such licenses are valid for one year. Currently, 48 companies have one license each for both types of activity. After expiry, those companies are to comply with new requirements as established by legislation.
