During third qtr. of 2015, the specialists of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) conducted 15 planned and one unplanned inspection of the activity of providers of electronic communications networks and services. The planned inspections revealed that three providers admitted no deviations from legal norms, 10 providers committed infringements of regulatory acts and two providers are not operating.
According to an ANRCETI report, the most frequent infringements detected during the planned inspections were: inconsistency of the service provision contracts with the legal provisions in force (26%), failure to submit, within the deadlines, statistical reports (22%) and reports on revenues from electronic communications activities or presentation of false information in these reports (9%), failure to publish information on quality parameters (17%), non-payment of the regulatory and monitoring fees (13%).
The report shows that four providers remedied the infringements detected by ANRCETI inspectors, in relation to other six providers due prescriptions were issued. Three providers complied with the prescribed requirements, while the terms of prescriptions for the other three providers expire on October 21, 2015.
In this timeframe, ANRCETI examined six complaints regarding violations of legislation: three from providers of networks and electronic communications services, two from the Ministry of Information and Communications Technology and one on non-compliance with ANRCETI prescription. As a result, contravention procedures started and six contravention reports were made, among which three recorded unauthorized connection or admission of unauthorized connection to electronic communications networks, under Art. 252 of the Contravention Code (CC), two contravention reports referred to the use of radio frequencies/channels without a license or technical permit, punishable under Art. 248 (1) of CC and one referred to non-compliance with the prescription to remedy the infringements of general authorization obligations, under Art.247 (2) of CC. All the six reports were sent to Central Court of Chisinau municipality for examination.
In the timeframe October-December 2015, ANRCETI intends to carry out 14 planned inspections. The providers subject to upcoming inspections are nominated in the Schedule of Inspections for the fourth quarter of 2015, published on the official ANRCETI website.
