Two Methodologies Aimed at Regulating the Activity of Universal Postal Service Provider Published

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces that on October 7, 2016 – on the date of publication in the Official Gazette of the Republic of Moldova, two Administrative Board Decisions entered in force: on approving the Methodology for allocation of production costs for reserved and non-reserved postal services and Methodology for setting tariffs for postal services within the scope of universal postal service. Both methodologies can be found on ANRCETI official website, Section Legislation / Administrative Board Decisions.

The Methodology for allocation of production costs for reserved and non-reserved postal services was developed and approved by ANRCETI in coordination with the Ministry of Finance under the Law of Postal Communications (hereinafter - Law no. 36/2016), which states that the universal postal service provider represented by State Company "Posta Moldovei", designated by the same law, will provide analytical records in financial accounting separately per each service from the reserved and non-reserved sector, the latter being subject to separate accounting for services within the scope of universal postal service and those beyond it.

This Methodology determines the method of production cost allocation for reserved and non-reserved postal services provided by State Company "Posta Moldovei", the requirements for the preparation of the Report on production cost allocation and for the methodology used for that purpose. State Company "Posta Moldovei" will develop the last two documents, publish (at least on its website) and submit them to ANRCETI, before May 31 of the year following the financial reporting period. The first report on the production cost allocation presented to ANRCETI will cover the financial situation in 2017.

The Methodology for setting tariffs for postal services within the scope of universal postal service was developed and approved under Art. 4 of Law no. 36/2016, which states that ANRCETI approves the tariffs for postal services within the scope of universal postal service, as well as and the tariffs for the use of public postal network, in accordance with the methodology of tariff calculation. The methodology contains formulas for tariff calculation, specifying that tariffs calculation will be based on information from reports of State Company "Posta Moldovei", as provided for by the relevant regulations in force and the information provided by State Company "Posta Moldovei", at the level of detail required by ANRCETI under Annex 1 of the methodology.

According to the methodology, State Company "Posta Moldovei" will present annually before June 30, to ANRCETI, the Report on adjusted costs and revenues from services. After analyzing the report, ANRCETI is entitled to require that State Company "Posta Moldovei" revise the tariffs for postal services within the scope of the universal postal service and the tariffs for the use of the public postal network by other postal operators to provide services within the scope of universal postal service. The first Report on the adjusted costs and revenues from services will be sent to ANRCETI by State Company "Posta Moldovei" before June 30, 2018.

ANRCETI believes that the implementation of the first methodology will ensure consistent development of documents necessary to substantiate the tariffs applied by State Company "Posta Moldovei", whereas the second methodology will serve as legal methodological support for both calculation by State Company "Posta Moldovei" of tariffs for postal services within the scope of the universal postal services and tariffs for the use of public postal network and for verification, where appropriate, approval by those tariffs by ANRCETI.
