Public session to approve Board Decisions on identification of two relevant markets and designation of JSC „Moldtelecom” as SMP provider on both markets
The Administrative Board of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) is announcing for June 11, 2013, at 14.00, a public session to review and approve two draft Board decisions: on identification of the markets for call origination at fixed locations (Market 2 - doc. in state language) and traffic transit in public telephone networks (Market 9 - doc. in state language) and designation of „Moldtelecom” as an SMP provider on both these markets. The session will take place at ANRCETI’s office: (134, Stefan cel Mare bd., 5th floor, Conference Room).
The draft Decisions and analysis of Markets 2 and 9 (docs in state language) were publicly consulted in the timeframe April 23 – May 5, 2013. The comments and proposals submitted are laid down in the Synthesis of Recommendations no.1 and, respectively, no.2 (docs in state language).
According to the Explanatory Notes no.1 and no.2 (docs in state language) the second cycle of market analysis for Markets 2 and 9 showed that JSC „Moldtelecom” continues to have SMP on both markets and is to be designated by the Administrative Board as an SMP provider on both markets.
The two draft documents were developed pursuant to Art. 53 (1) of the Law on Electronic Communications providing for relevant market analysis to be performed by ANRCETI at least every 2 years, in order to find if there is effective competition on those markets and review the ex-ante regulatory remedies with the view of imposing, maintaining, modifying or withdrawing them from SMP providers.
Within cycle I of market analysis, markets 2 and 9 were identified through Administrative Board Decisions no.24 (doc. in state language) and no.25 of 19.08.2010, following which ANRCETI, through Decisions no.12 and no.13 of 21.06.2011, designated JSC „Moldtelecom” as an SMP provider on these markets. Consequently, via Decisions no.27 and no.28 of 01.11.2011, ANRCETI imposed special ex-ante obligations on this provider.
