In the first half of 2018, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI), as an authority entitled to find contraventions in the fields under its competence and apply sanctions to offenders, penalized seven providers and the manager of a company operating in this field, for non-compliance with the general authorization conditions for the provision of electronic communications networks and services. According to an ANRCETI report, the providers were fined, pursuant to the Contravention Code, ranging from 6,000 lei to 12,000 lei (120-240 conventional units – c.u.), while the manager was fined 1,500 lei (30 c.u.).
The report states that the penalties were applied for failing to submit in due time reports on technical and financial statistical data related to the provision of electronic communications networks and services, reports on revenues from activity in this field and for non-payment of regulatory and monitoring fees.
ANRCETI also identified and examined two cases of unauthorized use of radio channels/frequencies, two cases of breach of rules for protection of electronic communications lines and installations and two cases of unauthorized connection or admitting unauthorized connection to electronic communications networks. The fines were applied as follows: 12,000 lei (240 c.u.), 6,000 lei (120 c.u.) and 1,500 and 2,500 lei, accordingly (30 and 50 c.u.).
During the same period, ANRCETI started contravention proceedings on a case on installation or use of radio communication stations, including broadcasting antennas, without prior coordination with the authorized body and without obtaining a due authorization for this use, for which offender was fined 15,000 lei (300 c.u.). Overall, in the first half of current year, as a result of the examination of contravention proceedings started ANRCETI, fine estimated at 115,000 lei were imposed.
In accordance with the provisions of the Code of Contravention, the Agency's specialists, empowered by its director, find contraventions in the field of electronic communications, postal communications and information technology and prepare the minutes, whereas Director and Deputy Directors examine the contraventions and apply sanctions, pursuant to the Code. The fines applied are fully transferred to the national public budget.
