The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) published on its official website the Guidelines on Access to Properties, which provides clarifications and recommendations for providers of public electronic communications networks, public entities of different levels, private owners and holders of physical infrastructure, for the application of the regime of access to public or private property and shared use of infrastructure associated with electronic communications networks. The document was developed by ANRCETI on pursuant to the provisions of the Law on access to properties and shared use of the infrastructure associated with public electronic communications networks (hereinafter "Law 28/2016"), in force since 15.04.2016.
The development and publication of the guidelines represents a component of the information campaign, organized by ANRCETI for the purpose of reaching out and informing electronic communications providers, public entities of different levels and private property holders about the provisions of Law nr. 28/2016, their rights and obligations according to this Law.
The Guidelines are structures into five chapters, which describe the conditions of access on public and private property for the construction (installation), maintenance, dismantle, replacement, transfer or retooling of public electronic communications networks or elements of infrastructure necessary to support such networks, conclusion of contracts of access to properties, sharing of infrastructure associated with electronic communications networks, rules for the authorization of construction (installation) works related to networks.
By Law no.28/2016, ANRCETI is entitled to ensure the compliance with the provisions of this law by electronic communications providers and public or private property holders when obtaining and exercising the right of access to properties and shared use of infrastructure associated with public electronic communications networks.
Following the entry in force of Law no. 28/2016, ANRCETI started an awareness-raising campaign in order to inform the public about the provisions of the Law. During the campaign, ANRCETI developed and published on its official web page, in July 2016, a special sections entitled Access to properties, while in November organized three seminars dedicated to the implementation of this Law for the representatives of public authorities in the central and southern part of the country.
