As of April 29, 2016, the date when the Law on Postal Communications (Law no. 36/2016) became effective, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) took over the powers of postal services market regulation, as provided by the mentioned Law. In order to fulfill its new responsibilities, ANRCETI determined the actions needed for the enforcement of the provisions stipulated by Law No.36/2016 as regards its competence. Previously, before Law no. 36/2016 became effective, the postal sector regulatory powers were exerted by the Ministry of Information Technology and Communications.
The new law seeks to support the liberalization of the postal market, the implementation of the universal postal service and the general authorization regime for the provision of postal services. By this Law, the State Enterprise "Posta Moldova" was designated as universal postal service provider. The law provides for the set of universal postal services, the requirements and conditions necessary to be ensured by the universal postal service provider in service delivery.
The new responsibilities assigned to ANRCETI, pursuant to Law no. 36/2016, are aimed at implementation of the general authorization regime for the provision of postal services, supervision and monitoring of compliance with the obligations imposed on the universal postal service provider and the conditions of the general authorization regime, approving tariffs for the postal services within the scope of the universal postal service and tariffs for the use of the public postal network, in accordance with the pricing methodology developed and approved by ANRCETI, establishing the mechanism of funding and compensation of the net cost of universal postal service provision. ANRCETI is also responsible for solving the complaints from post service users and disputes between postal service providers.
ANRCETI is planning to conclude the work on drafting the regulatory documents for tariff setting and general authorization regime in the fourth quarter of 2016, a deadline set by the Law. By this date, ANRCETI will also create a public register of postal service providers, which will be published on the official website of the regulator.
Law no.36/2016 sets out the principal terms and conditions for activity of postal communications, the legal framework for postal service provision and access to universal postal service, the relations between postal service providers and users, the rights and obligations of the state, individuals and legal entities. The enforcement of this Law is provided by the National Action Plan for the implementation of the Association Agreement Moldova-European Union 2014-2016.
