National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) opened public consultations on its official web page on the draft analysis (.pdf) of the transit market for traffic in public telephone networks (Market no. 9) and the project (.pdf) of the ANRCETI Administrative Board Decision regarding the ex-ante regulation of this market. The deadline for submitting recommendations on the papers submitted for consultation is December 21, 2018.

The draft documents were developed in accordance with the provisions of Art. 57 and Art. 61 paragraph (1) of the Electronic Communications Law no. 241/2007, which provide that ANRCETI identifies relevant markets and analyzes them within 3 years from setting a previous measure for those markets, in order to establish whether those markets are effectively competitive.

According to the Explanatory Note to the draft documents, as a result of the analysis, ANRCETI concludes that Market 9 is still susceptible to preventive regulation, and JSC Moldtelecom continues to hold significant power on this market. Hence, ANRCETI concluded that it was necessary to maintain the special preventive obligations imposed previously on this provider.
