On October 29, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) implemented the general authorization regime for the provision of postal services. In the following one-month timeframe, the first 26 entrepreneurs, intending to provide postal services, submitted their notifications to ANRCETI and were recorded in the Public Register of postal service providers. Thus, they obtained the legal right to provide services on this market. Most of these entrepreneurs had provided such services before the new legal regime entered in force, while four of them are new entrants.
According to the provisions of the Law on Postal Communications no. 36 din 17.03.2016 (hereinafter – Law 36/2016), in force since April 29, 2016, the postal service providers operating on the date of entry in force of the given law, wishing to continue providing postal services, were required to notify ANRCETI, in the timeframe October 29 - November 29, about their intention, in order to legalize their business on this market. Other natural or legal persons, registered as entrepreneurs in the Republic of Moldova, intending to provide postal activities, can enter the market on basis of the general authorization regime, without time limitation.
The list of providers authorized by ANRCETI includes SE "Posta Moldovei", designated by Law No.36/2016 as universal postal service provider, the enterprises representing four international companies: DHL (SPN LLC), Nova Posta (NEW POST INTERNATIONAL MLD LLC), TNT (JV CORST GROUP LLC) and UPS (FCC UPS - MOLDOVA LLC), other providers operating on the postal market. Almost all 26 entrepreneurs indicated in their notifications that they would provide the full range of postal services.
By Law No.36/2016, ANRCETI was empowered with regulatory functions in the postal sector, including the implementation of the general authorization regime for the provision of postal services. This regime allows the provision of postal services without obtaining an explicit decision from ANRCETI, by notification about the intention to provide activities for the provision of postal services.
The notification procedure includes filling in the standard notification form, which can be downloaded from the official website of ANRCETI and subsequently submitting it to ANRCETI (134, Stefan cel Mare bd., MD-2012, Chisinau). The documents related to the general authorization regime are prepared by ANRCETI free of charge and gives the applicant the right to provide postal services without any time limit.
