The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) published on its website for public consultation the draft (.pdf) Administrative Board Decision approving standard Form of notification for the provision of postal services, standard Certificate regarding registration in the public Register of public postal service providers and the notification about ceasing postal service provision. These Forms are necessary for the implementation of the general authorization regime in the postal sector, which will be implemented by ANRCETI in accordance with the Law of Postal Communications (hereinafter - Law no. 36/2016). The public consultation will last through July 20, 2016 - the deadline for submitting recommendations on the document.
According to the Explanatory Note, the document was drafted pursuant to Law No.36/2016, which states that postal services are performed under the general authorization regime, enabling the provision of postal services by notifying the regulatory authority of the intention.
According to Law No.36/2016, any natural or legal person, registered as entrepreneur, who intends to provide postal services, before starting work, shall submit to ANRCETI a notification, obligatorily by filling in the standard form established and updated by ANRCETI. The regulator, within 15 days after the notification was submitted, shall issue a standard Certificate to the notifying person, attesting the receipt of notification and the registration in the Public Register, as well as the provider’s rights and obligations. Postal service providers intending to cease the activity are required to notify ANRCETI and inform users at least 30 days before the date of ceasing activity.
