National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) is opening public consultation for the following projects:
1. Draft market analysis for the market of wholesale local access provided at a fixed location (Market 4) and the market for wholesale central access provided at a fixed location for mass-market products Market 5).
2. Draft decisions on ex-ante regulatory measures for Market 4 and Market 5.

The deadline for submitting recommendations on the documents under public consultation is December 19, 2023.

According to the Informative Note on the draft markets' analysis, ANRCETI conducted the 6th iteration of the market analysis and concluded that the definition of Market 4 and Market 5 does not differ from the previous one regarding market boundaries. Geographically, based on local competitive conditions, these markets have been delineated into two sub-national geographic markets each.

The application of the Three Criteria Test proved that these markets continue to be susceptible to preventive regulation. The detailed analysis of Markets 4 and 5 showed that JSC Moldtelecom continued to hold significant power in these markets and is expected to be designated by ANRCETI Administrative Board as a provider with significant power on these markets.

However, taking into account different competitive conditions at sub-national level on the retail broadband access market, ANRCETI expanded the list of urban communities falling within the boundaries of sub-national geographic Market 4a and 5a, excluding some special ex-ante obligations previously imposed on JSC Moldtelecom in areas where the conditions are competitive enough.
