PUBLIC CONSULTATION OF ANRCETI PROGRAM OF REGULATORY ACTS DEVELOPMENT FOR 2024

On November 23, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) presented for public consultation, on its official website www.anrceti.md, the draft Administrative Board Decision approving ANRCETI Program of Regulatory Acts Development for 2024 (hereinafter - the Program). The consultation will last till December 14, 2023, which is the deadline for submitting proposals on the document.

The draft Program was developed in accordance with the provisions of the Regulation on Public Consultation Procedures with Civil Society in the Decision-Making Process, approved by Government Decision no. 967/2016, aiming to ensure transparency in ANRCETI's decision-making process.

The Program includes draft normative acts designed to develop and update the regulatory framework for electronic communications, in accordance with the provisions of the Electronic Communications Law no. 241/2007.

According to the Informative Note to the draft document, ANRCETI aims to develop a set of new normative acts in 2024, as well as to modify some existing regulations provided by specialized laws and normative acts and sectoral policy documents, addressing the following issues:
- issuance of a decision on limiting the number of licenses for the use of radio frequencies/channels in the frequency bands 700 MHz, e900 MHz, 1500 MHz, 2300 MHz, 2600 MHz, 3600 MHz, and 26 GHz for the purpose of providing public electronic communications networks and publicly available services;
- developing auction documents: procedures, specifications, and standard special license conditions for the use of radio frequencies/channels in the frequency bands 700 MHz, 900 MHz, 1500 MHz, 2300 MHz, 2600 MHz, 3600 MHz, and 26 GHz, for the purpose of providing public electronic communications networks and publicly available services, as applicable, updating certain existing normative acts;
- amending the decision approving the statistical reporting forms for providers of public electronic communications networks and/or services;
- amending the decisions on quality indicators for publicly available electronic communications services and the Methodology for measuring and evaluating the quality parameters of publicly accessible electronic communications services provided through terrestrial mobile cellular public networks GSM, UMTS, and LTE in the frequency bands 800, 900, 1800, 2100, and 2600 MHz;
- developing the Methodology for calculating fees for the use of radio frequency spectrum;
- setting measures for ex-ante regulation of the market for traffic transit in public telephone networks (Market 9 - iteration 7), etc.
