Public Session to Approve Preventive Regulatory Measures for Market of Traffic Transit in Public Telephone Networks
The Administrative Board of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announced for Thursday, December 1, 2016, at 10:00, a public session for examination and approval of draft (.pdf) Decision on regulatory preventive measures for Market 9 - traffic transit in public telephone networks. The session will take place at ANRCETI office (134 Stefan cel Mare bd., 5th floor, Conference Room).
The draft documents of market analysis (.pdf) and Board Decision on regulatory preventive measures for Market 9 were subject to public consultations in the timeframe November 8 – 23, 2016. During the consultations, ANRCETI received no comments or recommendations. The two documents, in final readings, are available on ANRCETI Web site.
The draft documents were developed within the fourth round of relevant market analysis, carried out according to Art. 53 (1) of the Law on Electronic Communications, which states that ANRCETI shall analyze relevant markets at least every two years, in order to find whether the markets are effectively competitive, revise, as appropriate, the preventive regulatory measures and decide whether to maintain, amend or withdraw some obligations previously imposed on providers designated as having significant market power on those markets.
According to the Explanatory Note, ANRCETI, as a result of the market analysis, found that Market 9 was susceptible to ex-ante regulation and that JSC "Moldtelecom" maintained it significant power on that market, which entails the need to maintain the previously imposed ex-ante regulatory remedies.
Thus, the draft decision subject to approval proposes to maintain the previously imposed ex-ante regulatory remedies for JSC „Moldtelecom” as an SMP provider on Market 9, as stipulated by ANRCETI Administrative Board Decision no. 28 of 01.11.2011, with subsequent amendments.
