for providers of public electronic communications networks and/or services
CONGRATULATIONS!
You have been registered in the Public Register of electronic communications network/service providers, thus gaining the right to:
1) provide specifically those types of public electronic communications networks and services, that you indicated in the fiche of abstract description, which is an integral part of the notification;
2) apply for collocation of equipment associated with your public electronic communications networks;
3) set and apply tariffs for the provision of electronic communications networks, pursuant to the provisions of the legislation in force;
4) negotiate and conclude interconnection and access agreements with other providers of public electronic communications networks, appropriately authorized as required;
5) apply for licenses for the use of state limited resources (radio channels, radio frequencies, numbering resources) according top re-established procedure;
6) apply for technical permits for the use of radio communications stations, where you are planning to use the categories of radio frequencies, requiring no license issuance;
7) use your public electronic communications networks for broadcasting and re-transmission of audiovisual programs, but only after going through the authorization procedures required by the audiovisual legislation.
IMPORTANT!
Note, that as a provider of electronic communications networks and/or services, you are liable to:
1) comply with the general authorization conditions prescribed in the Regulation on General Authorization Regime and license issuance for the use of limited resources for the provision of public electronic communications networks and services, approved by ANRCETI Administrative Board Decision no.10 of August 28, 2008 (Official Gazette no.174/498 of September 16, 2008) and placed on ANRCETI web page -

2) use only adequate cables and equipment in your networks, duly certified and marked, as required by the regulations in force, on the territory of the Republic of Moldova, including the billing system.
3) negotiate interconnection and access agreements with other providers of public electronic communications services, duly authorized as established, upon their request, under the terms and conditions prescribed in the regulations in force;
4) ensure the security of the personnel operating your public electronic communications networks, according to the regulations in force;
5) take adequate technical and organizational measures in order to ensure the security of networks and services against unauthorized access;
6) take adequate technical and organizational measures in order to ensure the protection of personal data of users of public electronic communications services you provide;
7) take adequate technical and organizational measures in order to guarantee confidentiality of electronic communications within your public electronic communications networks, under the law;
8) ensure non-discriminatory access of end-users to public electronic communications services you provide;
9) ensure quality and continuity of public electronic communications services you provide, according to the regulations in force;
10) obtain all necessary authorization documents, prescribed by the legislation on environment protection and the legislation on authorization and quality of constructions;
11) comply, for the entire duration of activity, with the plans of urban and territory design, according to the regulations in force;
12) allow authorized bodies to conduct operative investigation activity in electronic communications networks, under the law, and provide these bodies with the necessary technical data;
13) submit to ANRCETI, according to the regulations in force, quarterly and annual reports that include statistical, technical and financial data related to the provision of public electronic communications networks and services (http://en.anrceti.md/formulare_rapoarte_statistice);
14) pay to ANRCETI regulatory and monitoring fees, under the legislation in force and in compliance with the Instruction on Regulatory and Monitoring Fees approved by ANRCETI Administrative Board no. 17 of June 02, 2010 -

15) pay to ANRCETI fees for numbering resources assigned and used in public electronic communications networks; according to the regulations in force;
16) ensure quality indicators you are liable to comply with, and practice tariffs correlated with such indicators, in the provision of public electronic communications services;
17) offer for free, on a monthly basis, to every subscriber, upon request, a detailed bill to enable him to verify the correspondence between his payment liability and the voice telephony services effectively provided;
18) provide ANRCETI with a copy of every interconnection and access agreements concluded, within 10 days from the date of their conclusion, as well as all the information with reference to the modification or termination of such agreements, accompanied by confirming documents, as appropriate, within 10 days from the date the modification or termination was applied;
19) provide ANRCETI with the information requested by ANRCETI within the terms and at the level of detail, as indicated by ANRCETI, under the law;
20) make, keep and update the technical dossier of the public electronic communications network, according to the regulations in force;
21) ensure free access of ANRCETI personnel to the premises and territory of your company, as well as to the documentation and information necessary for monitoring and conducting, within the scope of competence, the control of compliance with the provisions of normative acts governing the activity in electronic communications field.
Note: The responsibility for non-compliance with the provisions of the electronic communications legislation is provided for in Art. 246-262 of the Contravention Code of the Republic of Moldova no. 218-XVI of 24.10.2008 (Official Gazette no.3-6/15 of 16.01.2009).

Request to holders of licenses issued before June 10, 2008,
to comply with the new general authorization regime
In order to keep and update the Public Register of Providers of Electronic Communications Networks and Services, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) requires license holders, licensed by the Agency before June 10, 2008 that are currently operating and intend to continue their electronic communications activity, to abide by the general authorization regime prescribed by the Law on Electronic Communications no. 241-XVI dated 15.11.2007.
In this respect, license holders are invited to file a notification to the Agency, in compliance with the Regulations on General Authorization Regime and License Issuance for the Use of Limited Resources in the Provision of Public Electronic Communications Services and additionally – an application for license withdrawal.
The procedure of transition to the general authorization regime, including the registration of providers in the Public Register of Providers of Electronic Communications Networks and Services, is free of charge. The general authorization is not time-limited.
The services included in types of activities licensed by the agency before 10.06.2008 are included in the types of public electronic communications services subject to the general authorization regime, as follows.
