1. I am a subscriber of a fixed telephone service provider and I cannot make calls to other voice telephony networks. Why?

Answer In order to enable the subscribers of a telephone network to call subscribers of other telephone networks, it is necessary that these networks be interconnected. In this respect, the legislation in force provides for interconnection agreements between service providers. The information regarding the existence of such agreements can be supplied by ANRCETI. Any provider has the right to negotiate an interconnection agreement with any other provider of a public electronic communications network, in order to be able to provide publicly available electronic communications services. At the same time, any provider is bound to negotiate an interconnection agreement with a duly authorized third party, upon the party’s request, for the provision of publicly available electronic communications services. If a provider refuses to conclude an interconnection agreement upon the request of a third party, the latter can address to ANRCETI to mediate the dispute. top

2. A provider of electronic communications services and/or networks intends to install electronic communications networks in our apartment building. What do we have to do, if are against that?

Answer A provider of electronic communications services and/or networks has the right to install a network within the area of an apartment building of common property, on condition that the provider is duly authorized by ANRCETI to provide public electronic communications networks and that the association of owners/lodgers give their written consent to the performance of such works. If a service provider has installed the networks without the written consent of the association of owners/lodgers, the latter can address to ANRCETI or to court. top

3. Are there any normative acts on restriction of population exposure to the effects of network-generated magnetic fields? Who is the competent authority in this respect?

Answer According to the provisions of the Law on Sanitary and Epidemiological Insurance no. 1513-XII of June 16, 1993, all sanitary and epidemiological expertise, investigations, examinations, research, experiments and tests, toxicological, hygienic and other assessments, (including those related to the degree of electromagnetic field impact on a human being) are carried out by the State Sanitary and Epidemiological Service, by duly authorized experts, using measurement and investigation methods and proceedings, acknowledged by the Ministry of Health. Based on the outcome of investigations, examinations, research, experiments and tests, state sanitary head-physicians and their deputies approve decisions in this matter and issue advice, hygienic certificates, sanitary operation authorizations. In relation to this issue, there was a Decision of the State Sanitary Chief-Physician of the Republic of Moldova no. 01-8/35 of 19.01.1998 about ratification of a number of normative-hygienic documents providing for sanitary and hygienic norms and requirements with reference to sources of nonionising radiation. top

4. I consider that the electronic communications service provider infringes upon my rights as set forth by law. What do I do?

Answer You have the right to address the issue directly to court. However, before you do that, we recommend that you should: - to file a petition to the service provider. He is obliged by the legislation in force to provide a reply regarding the problem, within 30 days from the date the petition had been registered, and to take due action.. - in case you consider the reply and the actions unsatisfactory, you can apply to ANRCETI, attaching the provider’s reply, so that ANRCETI can consider the issue within its competence, established by law. ANRCETI shall examine the petition within 30-day maximal term as of the date the petition has been registered and, as the case may be, take administrative actions in compliance with its competence as prescribed by law. top

5. I filed a written complaint to the provider of electronic communications services, but no reply followed. What should I do?

Answer File a petition to ANRCETI or call the „hotline” 0-800 800 80 (free call). top

6. I am a user of GSM cell mobile services. I have faced the impossibility to make phone calls for a period of time, which fact was quite an inconvenience. What rights do I have?

Answer Where the impossibility to use the GSM services is imputable to the service provider (network failures), according to the provision of the Regulations on GSM Cell Mobile Telephony Service Provision, the provider must recalculate the subscription fee for the telephone numbers unused during the network failure, no matter if the subscriber requested that or not, used or did not use the services in that timeframe. If you consider that the provider failed to fulfill its obligation as provided for in the Regulations, you can direct the issue to ANRCETI for examination. top

7. I am a cable TV network subscriber and I am not content with the grid of re-transmitted TV programs. What is the authority I need to address to?

Answer If you are discontent with the image and sound quality, you need to address to the provider to remove the technical disturbance in the network. If the provider fails to take action, you can file a petition to ANRCETI or call the „hotline” 0-800 800 80 (free call). If you disagree with the program grid of the re-transmitted programs, you need to address to the Audiovisual Coordinating Council. www.cca.md. top

8. I am a retired labor veteran and I would like preferential payment conditions for having a telephone installed at home. Can I benefit from this right?

Answer According to the legislation of the Republic of Moldova currently in force, the retired and labor veterans do not enjoy preferential payment conditions for telephone line installation. However, depending on the existing technical possibilities, service providers offer specific preferential payment conditions for services, as well as the possibility to break the installation fee into installments. top

9. My telephone bill contains international calls I did not make and I am not aware of. What shall I do?

Answer Possibly, the international telephone connections you talk about appeared as a result of using the Dial-Up access to the Internet via the telephone line. These connections are possible when you access some of the banners or references containing texts like "Free instant access". In most cases such links refer you to sites of specific content. If you accept the proposal, a window will appear with a text in English, intending to obtain your affirmative answer for installation and use of an Internet access program of a foreign operator. If you click "Please Enter Now!” ("Enter", "Next", "Ok"), a program will be installed in your computer, visible or hidden, which will interrupt your current connection with your local operator and will dials an international telephone number, by which the computer immediately (then implicitly) will make the Internet connection. The access can take place even in your absence, suffice that your computer is connected to the telephone line. As a consequence, at the end of the month the fixed service provider will charge you for international phone calls according to the tariffs in force, as you used an international connection to access the Internet. The cost of such connections can reach 100 lei/minute, even more, depending on the country, daytime, weekday when the connections took place. If you are a Dial-Up Internet user, in order to avoid unsolicited international connections, we suggest that you have the service „password restriction of outgoing calls” activated, settling this issue with the service provider. The activation of this service shall bar the unauthorized access to dialing international numbers. We also recommend that you avoid accessing all kinds of dubious banners or references with inscriptions "Free (instant) access", "No credit card required", etc, and use firewall, antispyware and antivirus programs. top
