The Administrative Board Intends to Approve First Draft Decisions on Designation of Providers with Significant Market Power on Two Relevant Markets
Next week, the Administrative Board of the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI – www.anrceti.md) is summoning a public session to approve the draft decisions on designating JSC „Moldtelecom” as a provider with significant market power on the market of wholesale access to network infrastructure at a fixed location and on the market of wholesale broadband access. The session is scheduled for Tuesday, September 28, 14.00, in ANRCETI office, 5th floor, conference hall (134 Stefan cel Mare bd.).
The draft decisions were developed pursuant to the Law on Electronic Communications and ANRCETI Administrative Board Decisions no.09 and no.10 of 18.03.2010 on the identification of the market of wholesale access to network infrastructure at a fixed location and the identification of the wholesale of broadband access market.
Both draft decisions were subject to public consultations on the Agency Web page on August 11 – September 6, 2010. ANRCETI received objections and proposals from JSC “Moldtelecom” and the national Agency for Competition Protection. These are compiled in the first and in the second synthesis of recommendations (docs in state language).
The draft decisions are based on detailed analyses of the market of wholesale access to networks infrastructure at a fixed location and the market of wholesale broadband access (docs in state language), conducted by ANRCETI specialists, with the support of the consultants from the technical assistance project, provided to the agency by EBRD.
According to the Explanatory Note, the analyses proved that JSC “Moldtelecom” has significant market power on both markets: wholesale access to network elements at a fixed location and broadband access. As a result of the analyses, the Agency found significant market power of this company on both markets.
