Mechanism for Funding and Compensation of Net Cost of Universal Postal Service Provision in Force

The financing mechanism for compensating the net cost of universal postal service provision, approved by Government Decision no.1237 of 11.11.2016, entered in force on November 18, 2016, the date when it was published in the Official Gazette of the Republic of Moldova. The document was drafted under the provisions of the Law on Postal Communications (Law no. 36/2016), by the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) and aims to mitigate any financial losses incurred by the universal postal service provider.

The mechanism regulates the procedure of calculation and compensation of the net cost of universal postal services provision by SE "Posta Moldovei", designated by Law no. 36/2016 as universal postal service provider. Under that law, the financing of the universal postal service is accomplished by granting to SE "Posta Moldovei" the exclusive right to provide reserved postal services, i.e. services of delivery of domestic and international postal items, whose weight is below 350 g.

According to the normative act approved by the Government, every year before May 31, SE "Posta Moldovei" is required to submit to ANRCETI a report on the net costs of providing postal services within the scope of the universal postal service, for the financial year proceeding the year of reporting. Those costs need to be calculated by using the formula set out in the mentioned document. If the value of the net cost is higher than 1% of the revenues of SE "Posta Moldovei" from the provision of postal services within the scope of the universal postal service, the company may request that ANRCETI reserve the exclusive right to provide advertising mail. After analyzing the report, ANRCETI will decide on the opportunity to reserve or not the exclusive right to deliver advertising mail.

The universal postal service means the permanent provision of a set of postal services of a specified quality in all areas of the country at affordable prices for all users. The access of any natural or legal person to the universal postal service is guaranteed throughout the country under non-discriminatory conditions.

The set of services within the range of universal postal service is established by the Law no.36/2016 and can be found on ANRCETI official website www.anrceti.md, section Postal Communications.

Since April 2016, under Law no. 36/2016, ANRCETI took over the regulatory and supervisory powers as regards the postal service market.
