National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) announces that the special ex-ante obligations imposed in 2012 to JSC "Moldtelecom" in connection with significant market power on market 1 (access of end-users, natural and legal persons to the public fixed telephone network at a fixed location) are maintained.

Previously, under art.53 (1) of the Law on Electronic Communications ANRCETI performed the second round of market analysis in order to ascertain whether market 1 is effectively competitive and review the preventive regulatory measures as to their maintenance, amendment or withdrawal of certain obligations previously imposed on the SMP provider on this market. After the repeated analysis of market 1, ANRCETI found major barriers to market entry, no visible trend of competition, whereas the measures under the Competition Law are not sufficient to solve the deficiencies in this market.

Based on this analysis, ANRCETI Administrative Board, by Decision no. 59 (doc. in state language) of 10.24.2013, identified market 1 as susceptible to ex-ante regulation and designated JSC "Moldtelecom" as an SMP provider on this market.

In this regard and pursuant to Art. 50, in conjunction with Art. 53 (1), (3) of the Law on Electronic Communications, the special ex-ante obligations imposed on JSC "Moldtelecom" by ANRCETI Administrative Board Decision no. 12 (doc. in state language) of 25.05.2012, are maintained without modification.
