Regulations on Control Procedure in Electronic Communications entered in force

The National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI), in its control activity, will be guided by the new Regulations on control procedure in electronic communications, published in the "Official Gazette of the Republic of Moldova" on September 12, 2008.

Initially the document was subject to public consultations, then to coordination procedure with the stakeholders, positively endorsed by the Working Group of the State Commission for regulation of entrepreneurial activity and finally examined and approved by ANRCETI Administrative Board.

Ion Pochin, ANRCETI Deputy Director, said that the new regulations had been developed in compliance with the requirements of the Law on Electronic Communications which empowers ANRCETI to supervise compliance with the legislation governing the sector and to take actions to prevent and remove non-compliance.

The Regulations set forth the procedure for control actions undertaken by the Agency, types of control and their purposes. Such actions will be focused on quality of service and compliance with the conditions of general authorizations or licenses, regulations issued by ANRCETI on user rights protection, transparency of tariffs and the conditions of use of public electronic communications services.

The new Regulations provide for the Agency to subject network and service providers to planned control actions once a year. Those providers will be selected based on the supposed prejudice that could be caused by their violation of the legislation in force. The number of unplanned control actions, regardless of the purpose, cannot exceed 50% of the planned control actions. The Agency is bound to notify the provider 3 days before a planned control action and on the very day before the unplanned one.

In this context, Ion Pochin mentioned that in exercising its control activity, the Agency does not confine to detecting violations and sanctioning them, but focuses on prevention of any deviation from legal provisions by electronic communications operators.
