National Regulatory Agency for Electronic Communications and Information Technology of the Republic of Moldova

On December 8, the National Regulatory Agency for Electronic Communications and Information Technology (ANRCETI) proposed for public consultations, on its official website, the draft (.pdf) Administrative Board Decision on the approval of the Program for Regulatory Acts Development for 2017. The consultations will last through December, 22, 2016 which is the deadline for submitting recommendations on the document.

The draft Program was developed pursuant to Regulation on Procedures to Ensure Transparency of Decision-Making Process, approved by Government Decision no. 967 of 09.08.2016, and aims to facilitate the access of stakeholders to the information of public interest of ANRCETI.

The Program includes 18 draft regulatory acts, the majority of which are addressed to the ex-ante regulation of relevant electronic communications markets and the implementation of the Program for Transition to Digital Terrestrial Television, approved by Government Decision no. 240 of 08.05.2015, with subsequent amendments.

Thus, next year ANRCETI will continue the fourth round of relevant markets analysis, started in 2016, with six relevant markets. The analysis is designed to determine the existence of effective competition on the six markets and revise, as appropriate, the preventive regulatory measures in terms of maintaining, amending or withdrawing the obligations previously imposed on providers designated as having significant market power on those markets.

ANRCETI also plans to develop and approve the documents necessary for the auctions on license issuance for the use of radio frequencies/channels of 470-694 MHz band for the provision of networks/multiplexes with regional/area coverage and for the provision of network/multiplex C with national coverage and electronic communications services in the digital terrestrial television system. According to the draft document, in 2017, the following documents are to be approved: the new version of the Regulation on Control Activity by ANRCETI, Administrative Board Decision on establishing the method of application and the format of the information required for the development of the digital inventory of public electronic communication networks and associated infrastructure elements and a set of amendments and additions to some regulatory documents previously approved by ANRCETI.

The Explanatory Note to the draft document provides that after approval, it may be amended and/or revised, depending on the amendments to the legal/regulatory framework, policy documents in areas regulated by ANRCETI.
