Instruction on regulatory and monitoring fee entered into force

Today, June 8, along with the publication in the Official Gazette of the Republic of Moldova, the Instruction (doc. in state language) on Regulatory and Monitoring Fee entered into force. It was approved by the ANRCETI Administrative Board (www.anrceti.md) in its Decision No. 17/02.06.2010. It was adopted in order to facilitate the enforcement of provisions of Art. 12 (5) of the Law on Electronic Communications no.241–XVI/15.10.2007 that lays down the mechanism of payment of regulatory and monitoring fees by providers of electronic communications networks and/or services.

The Instruction establishes a new procedure for reporting the revenues generated from activity in electronic communications, method of calculation and deadlines for regulatory and monitoring fees payment.

The Instruction requires that suppliers shall present to the Agency their reports on revenues from activity in electronic communications, on quarterly basis, before the 10th of the month following the quarter under report, by completing a standardized form Available in the Annex to the Instruction. The Agency will calculate the amount of regulatory and monitoring fee according to the formula set by the Instruction and will send the provider an invoice and a waybill according to the amount calculated, within 3 working days from the date of report presentation.

Suppliers must transfer payments on the Agency’s current account only on basis of issued invoice, quarterly, before the 15th of the month following the reporting quarter, or within 3 working days from invoice receipt. If the payment amount calculated by the Agency is less than 500 lei, the invoice and the waybill will be submitted, cumulatively, for a longer period but not exceeding the reporting year.

The Instruction is mandatory for all providers of electronic communications network and/or services. For non-compliance, they will bear responsibility, as required by law.

By the same decision the Board repealed earlier decisions of May 16, 2001 and June 20, 2002 relating to the calculation and payment of regulatory fees.

The amount of regulatory and monitoring fee for 2010 was established by Administrative Board Decision No. 258/27.10.2009 as 0.17% of the revenue generated from activities of electronic communications networks and service provision.
